An Act Respecting Surgical Facilities
His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
Regional Health Authorities Act
1( 1) Section 1 of the Regional Health Authorities Act, chapter 217 of the Revised Statutes, 2011, is amended
(a) in the definition “health services” by striking out “hospital services, addiction services” and substituting “hospital services, surgical services, addiction services”;
(b) in the French version in paragraph b) of the definition « services extra-muraux » by striking out “d’une entente qu’elle a conclue” and substituting “d’un accord qu’elle a conclu”;
(c) by adding the following definitions in alphabetical order:
“hospital services” means services that are provided in a hospital facility by a regional health authority. (services hospitaliers)
“surgical services” means surgical and diagnostic services that are provided in a surgical facility by a person other than a regional health authority under an agreement with a regional health authority. (services chirurgicaux)
1( 2) The heading “Ententes conclues par le ministre” preceding section 13 of the French version of the Act is amended by striking out “Ententes conclues” and substituting “Accords conclus”.
1( 3) Section 13 of the French version of the Act is amended in the portion preceding paragraph a) by striking out “ententes” and substituting “accords”.
1( 4) Section 34 of the French version of the Act is amended
(a) in paragraph a) by striking out “d’ententes” and substituting “d’accords”;
(b) in paragraph b) by striking out “d’ententes” and substituting “d’accords”.
1( 5) The heading “Ententes conclues par les régies régionales de la santé” preceding section 37 of the French version of the Act is amended by striking out “Ententes conclues” and substituting “Accords conclus”.
1( 6) Section 37 of the French version of the Act is amended in the portion preceding paragraph a) by striking out “ententes” and substituting “accords”.
1( 7) Paragraph 53(2)b) of the French version of the Act is amended by striking out “une entente” and substituting “un accord”.
1( 8) Section 65 of the French version of the Act is amended by striking out “d’une entente conclue” and substituting “d’un accord conclu”.
1( 9) Subsection 67(1) of the French version of the Act is amended by striking out “d’une entente conclue” and substituting “d’un accord conclu”.
Regulation under the Regional Health Authorities Act
2( 1) Section 2 of the French version of New Brunswick Regulation 2002-27 under the Regional Health Authorities Act is amended in paragraph c.1) of the definition « privilèges » by striking out “d’une entente qu’elle a conclue” and substituting “d’un accord qu’elle a conclu”.
2( 2) Paragraph 15b) of the French version of the Regulation is amended by striking out “d’une entente qu’elle a conclue” and substituting “d’un accord qu’elle a conclu”.
Medical Services Payment Act
3( 1) Section 1 of the Medical Services Payment Act, chapter M-7 of the Revised Statutes, 1973, is amended
(a) by repealing the definition “private hospital facility”;
(b) by adding the following definition in alphabetical order:
“private facility” means a private clinic or a hospital facility established, operated or maintained by a person other than a regional health authority as defined in the Regional Health Authorities Act, but does not include a surgical facility providing surgical services as defined in that Act; (établissement privé)
3( 2) Paragraph 2.01(b) of the Act is amended by striking out “private hospital facility” and substituting “private facility”.
3( 3) Subsection 5.1(2) of the Act is amended by striking out “private hospital facility” and substituting “private facility”.
3( 4) Subsection 11(2) of the Act is amended by striking out “subsection 2.02(2),”.
3( 5) Subsection 11.1(2.1) of the Act is amended by striking out “subsection 2.02(2) or”.
Regulation under the Medical Services Payment Act
4 Schedule 2 of New Brunswick Regulation 84-20 under the Medical Services Payment Act is amended by repealing paragraph (p.1).
